1. Who we are and what these terms cover

Mach One Reports is home inspection reporting software made by Three Blue Stars Inc, doing business as Mach One Reports ("Mach One Reports", "we", "us"). These Terms of Service are the agreement between you and us for your use of the Mach One Reports website, the portal at portal.machonereports.com, and every related service (together, the "Service").

By creating an account, starting a free trial, checking the "I agree to the Terms of Service" box at checkout, or using the Service in any way, you agree to these terms and to our Privacy Policy at machonereports.com/privacy. If you do not agree, do not use the Service.

If you are signing up for a company, you confirm you have the authority to bind that company to these terms.

2. Your account

You must be at least 18 years old and using the Service for your inspection business, not for personal or household use.

You agree to give us accurate, current information when you sign up (name, email, phone, company) and to keep it up to date.

You are responsible for everything that happens under your account. Keep your login private. Tell us right away at info@machonereports.com if you think someone else has used your account.

We may suspend or close an account that breaks these terms, is used for fraud, or puts the Service or other customers at risk.

3. The free trial

Every new subscription starts with a 30-day free trial. A valid payment card is required to start the trial, and Stripe holds the card on file. You are not charged during the 30 days.

On day 31 your card is charged for the plan you chose, at the price shown at checkout, and your paid subscription begins.

If you cancel before day 31, you are never charged. You cancel from the billing portal inside your account.

One free trial per customer and per business. The trial is for evaluating the Service, and we may end a trial early if it is being abused.

4. Plans and pricing

We offer a Regular plan, a Founders plan, and a Horizon Rescue plan, each billed monthly or yearly. Current prices are on our pricing page at machonereports.com and are shown at checkout before you start your trial. The price you see at checkout is the price you agree to.

Founders and Horizon Rescue are introductory plans. Your introductory rate applies for your first 12 months. Starting in month 13, your subscription moves automatically to the Regular price for your billing cycle (monthly or yearly). We will remind you by email before that happens.

Horizon Rescue requires proof that you had a Horizon account (see section 5).

White glove onboarding (we import your comment library, set up your account, and walk you through it on a call) is included with the Founders and Horizon Rescue plans.

Applicable sales tax is calculated and added at checkout.

We may change our prices. If a price change affects your plan, we will tell you by email at least 30 days before it takes effect, and it will apply from your next billing cycle after that notice. Your introductory rate will not be raised during your first 12 months.

5. Horizon Rescue proof requirement

The Horizon Rescue plan is only for inspectors who were customers of Carson Dunlop's Horizon software.

To keep the Horizon Rescue price, you must send us proof of your Horizon account during your 30-day free trial, before your first charge on day 31. Proof can be a Horizon bill, an account screenshot, or a link to your Horizon account. You upload it in the portal or send it to info@machonereports.com.

We review every proof. If we do not receive acceptable proof by day 31, we will move your subscription to the plan you qualify for, at that plan's price, before your first charge. We will email you about the change. Because this happens during the trial, nothing has been charged and no refund is involved.

Sending proof that is fake or belongs to someone else is grounds for closing your account.

6. Billing and renewals

Payments are processed by Stripe. Until our payment account moves, charges may appear on your card statement as Easy As Pie or Gray Lux, Inc, our affiliated company. By starting a subscription you authorize us and Stripe to charge your card for the plan price, plus any tax, on each billing date.

Subscriptions renew automatically, monthly plans every month and yearly plans every year, until you cancel. Your billing date is the day your trial ended, and it repeats on that date each cycle.

Your payment covers your billing period. When you pay for a month or a year, you get the Service for that whole period. If you decide to stop, you cancel from the billing portal, your subscription does not renew, and you keep using the Service until the period you already paid for ends. We do not charge you again after you cancel. The 30-day free trial is there so you can decide before your first payment.

If a payment fails, we will retry it and email you. If it keeps failing, we may pause your access until the balance is paid. You remain responsible for any amount owed.

If you dispute a charge with your bank instead of contacting us first, we may pause your account while the dispute is open.

7. Cancellation

You can cancel your subscription at any time from the billing portal inside your account. Cancellation takes effect as soon as you confirm it there.

When you cancel, your subscription stops renewing. You keep full access until the end of the period you already paid for (the end of the month for monthly plans, the end of the year for annual plans). No refund is given for the remaining part of that period.

If you cancel during the free trial, your access ends when the trial ends and you are not charged.

After your access ends, you can still request an export of your data for 30 days by emailing info@machonereports.com. After that we may delete it (see our Privacy Policy for retention).

8. Your data and your content

Everything you put into Mach One Reports stays yours: your inspection data, photos, voice recordings, reports, templates, contacts, and your comment library. We claim no ownership of any of it.

You give us only the permission we need to run the Service for you: to store, process, transcribe, match, back up, and display your content inside your account, and to deliver reports to the people you choose to send them to. We do not sell your content or use your clients as leads.

You can export your data at any time from inside the Service.

You are responsible for your content. You confirm you have the right to upload it, including any comment library you bring from another product, and that it does not break any law or anyone else's rights.

We keep your account walled off from every other account. Only people you add to your account can see your data.

9. Acceptable use

You agree not to: share your login or resell access to the Service; copy, scrape, reverse engineer, or build a competing product from the Service; upload malware or anything illegal; use the Service to harass anyone or to break the law; interfere with the Service or other customers' accounts; or use automated tools to pull data from the Service in bulk except through the export features we provide.

We may remove content or suspend accounts that break these rules.

10. How the Service works, and your responsibility for your reports

Mach One Reports transcribes what you say, searches your own comment library, and places your own saved wording into your report. When nothing matches, it keeps your spoken words. Transcription and matching are done by software, and software can make mistakes.

You are the inspector. You are responsible for reviewing every report before you deliver it and for its accuracy, completeness, and compliance with your state's inspection standards, your professional association's standards, and your contract with your client. Mach One Reports is a tool that helps you write your report; it does not perform the inspection and it does not replace your professional judgment.

We work hard to keep the Service available, and it is designed to keep capturing on site with no signal and finish when signal returns. We do not promise that the Service will be available at all times or free of errors. We may change, add, or remove features as the product grows.

11. Disclaimers and limits on our liability

The Service is provided as is and as available. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, Three Blue Stars Inc will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or claims from your clients, arising from your use of the Service or from any report you produce with it.

Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.

You agree to defend and hold us harmless from claims by third parties (including your inspection clients) that arise from your reports, your content, or your use of the Service in breach of these terms.

Some states do not allow certain limits, so some of these may not apply to you.

12. Changes, governing law, and contact

We may update these terms. If a change is material, we will email you and post the new terms at machonereports.com/terms at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the new terms.

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in California, and you and we consent to that jurisdiction.

We may transfer this agreement to an affiliated company or to a successor that takes over the Service; we will tell you if that happens, and your rights under these terms stay the same. You may not transfer your account or this agreement to anyone else without our written permission.

If any part of these terms is found unenforceable, the rest remains in effect. These terms plus the Privacy Policy are the whole agreement between you and us about the Service.
